Attorneys

with the documentation trail courts, umpires, and opposing counsel need to see.
Key Performance Metrics
What Attorneys Need from a Property Damage Estimate
Insurance litigation and appraisal disputes live or die on documentation. When your client's property damage claim has been underpaid, denied, or disputed by the carrier, the estimate you submit needs to do more than show a number — it needs to show exactly how that number was reached, what methodology was used, what documentation supports each line item, and why the carrier's figure is wrong.
A standard contractor Xactimate scope isn't built for that purpose. It's built for carrier submission, not legal scrutiny. When opposing counsel or a carrier's expert reviews it, they look for the same things any technically trained reviewer looks for: methodology gaps, pricing that doesn't match the local Xactimate matrix, line items without documented basis, and scope decisions that weren't tied to specific field evidence. Any one of those gaps weakens your position.

How a Litigation-Grade Xactimate Report Differs from a Standard Estimate
A standard Xactimate estimate is written to get a claim paid. A litigation-grade report is written to survive challenge. Those are different objectives – and the documentation requirements are different as well.
In a standard estimate, a line item is there because it’s part of the scope. In a litigation-grade report, a line item is there because the field evidence supports it, the local Xactimate matrix prices it, and the report explains both of those things in a way that a non-technical reader — a judge, a mediator, a jury — can follow. Scope decisions that seem obvious to an estimator need to be explained explicitly when the report is going into a legal proceeding. Methodology that’s standard practice in the claims industry needs to be documented as standard practice, with a reference to support it.
The Problem
Where Property Damage Reports Fail in Legal Proceedings
These are the four most common reasons property damage estimates don’t hold up in insurance litigation – and how we address each one.
Methodology not documented in the report
When opposing counsel asks how a line item was calculated, "Xactimate said so" isn't an answer that holds up. We document the pricing methodology - local matrix, date of pricing, and the basis for each scope decision - so the report can survive a technical challenge.
Scope decisions not tied to field evidence
Every item in a litigation-grade report needs to be traceable to something in the field documentation - photos, measurements, moisture readings, or inspection notes. Scope items that appear without that connection are easy targets for opposing experts.
Depreciation methodology not explained
ACV disputes are common in insurance litigation. If the depreciation calculation isn't documented - what was depreciated, at what rate, and by what method - opposing counsel has an easy line of attack on the entire damage figure.
Report not structured for non-technical readers
Judges, mediators, and jurors are not Xactimate users. A report that's clear to an estimator but opaque to a non-technical reader doesn't serve your client in a legal proceeding. We write scope narratives that explain the damage, the methodology, and the conclusions in plain language alongside the technical documentation.
What We Cover
Xactimate Services for Attorneys
Every report type attorneys need for insurance litigation, appraisal, and bad faith claims.
Independent property damage estimates
Expert-grade Xactimate estimates built from field documentation for use in insurance litigation - with full methodology documentation and scope narrative suitable for legal proceedings.
Carrier estimate rebuttal and analysis
We review the carrier's Xactimate estimate, identify every methodology error, pricing discrepancy, and unsupported exclusion, and produce a documented rebuttal your client can use in dispute or litigation.
Appraisal panel reports
Xactimate reports formatted and documented for use in the insurance appraisal process - with scope narrative, pricing methodology, and line item support structured for umpire review.
Bad faith claim documentation
When a carrier's handling of a claim supports a bad faith action, the property damage estimate is often a central piece of evidence. We produce reports that document both the damage scope and the gap between what was owed and what was paid.
Large loss and commercial reports
High-value residential and commercial property damage estimates for litigation - multi-trade, fully documented, with methodology transparent enough to withstand opposing expert review.
Forensic scope review
When you need to challenge an opposing expert's Xactimate estimate, we perform a forensic review - identifying methodology errors, pricing discrepancies, and scope decisions that aren't supported by the field documentation.
What Makes Our Attorney Reports Different
Built for legal scrutiny from the start
We don't write a standard estimate and reformat it for litigation. Every report produced for attorney use is built from the ground up with the documentation depth and methodology transparency that legal proceedings require.
Certified estimators with dispute experience
Every report is handled by an estimator with experience writing property damage files that have gone through carrier dispute, appraisal, and litigation review - not someone producing a standard scope for a different context.
Rewrite guarantee
If the report needs revision based on additional evidence, updated field documentation, or changes in the scope of the dispute, we revise at no additional cost within the original engagement.

What Makes a Property Damage Report Hold Up in Court
Most property damage estimates that fail in litigation fail for the same reason: they were written to get a claim paid, not to survive a technical challenge from opposing counsel. The line items are there, the numbers are reasonable, but the methodology behind each decision isn’t documented – and when an opposing expert or a judge asks how a number was reached, there’s no answer in the file.
That’s not a higher standard of estimating. It’s a different kind of document – one that’s built for a different audience and a different purpose. We’ve been producing reports at that standard for attorneys long enough to know exactly what opposing counsel looks for when they try to pull one apart. We build accordingly.
Common Questions from Attorneys
How is your report different from a standard contractor Xactimate estimate?
A standard contractor estimate is built for carrier submission. Our attorney reports are built for legal scrutiny – with pricing methodology documented, scope decisions tied to field evidence, depreciation methodology explained, and a scope narrative written for non-technical readers. The underlying Xactimate data is the same; the documentation depth and report structure are completely different.
Can you review and rebut an opposing expert's Xactimate estimate?
Yes – send us the opposing expert’s report and your client’s field documentation. We perform a forensic review identifying methodology errors, pricing discrepancies, and scope decisions that aren’t supported by the evidence, and produce a documented rebuttal you can use in the proceeding.
Do you provide expert witness testimony?
We produce expert-grade Xactimate reports and can provide a written declaration regarding methodology and scope decisions. For live expert witness testimony, contact us directly to discuss the specific proceeding and requirements.
How do you handle large commercial property damage claims for litigation?
Commercial litigation claims are handled with full trade breakdowns, methodology documentation for each phase of the scope, and a report structure appropriate for high-value dispute proceedings. Pricing for large loss litigation reports varies by complexity – contact us directly for larger files.
What if additional evidence comes in after the report is delivered?
We revise the report to incorporate new field documentation, updated inspection findings, or changes in the scope of the dispute at no additional cost, provided the new evidence relates to the original claim scope. Let us know when you submit if the evidence record is still developing.
